1. Object and Scope of Application

This document regulates the conditions of use, reservation and contracting of the tourist route services and official taxi experiences offered by TAXI SERVICES PROVIDER, SL (hereinafter, “TaxitourSpain”), with CIF B-66116633, address at C/ Caracas 13-15 Interior Nave 6, 08030 Barcelona, ​​and registered in the Mercantile Registry of Barcelona, ​​Volume 44022, Folio 0048, Entry 1, Page 444773.

Access and use of www.taxitourspain.com, as well as the contracting of the published services, implies express acceptance of these Terms and Conditions, the Privacy Policy, the Legal Notice and the Cookies Policy.

The applicable regulations are Spanish and European: LSSI-CE, RGPD, LOPDGDD and consumer and user legislation.

2. Definitions

  • User: Natural or legal person who accesses and/or contracts services through the website.
  • Provider: TaxitourSpain as a direct operator, providing services with its own fleet or through associated vehicles under the brand "elTaxi033," all of which are duly authorized and insured in accordance with current regulations.
  • Reservation: Application submitted online for a tourist taxi tour.
  • Service: Provision of a route, tour, or tourist experience in an official taxi, in accordance with the published conditions.
  • Passenger: Natural person who enjoys the contracted route.
  • On Show: Situation in which the passenger does not show up at the start of the experience.

3. Hiring and Reservation Process

3.1. Steps to book

  • Select the route or experience of interest, reviewing the details, itinerary, maximum duration, and conditions.
  • Complete the reservation form with the required information and expressly accept these Terms and Conditions.
  • Make full payment for the service using the enabled methods.
  • Payment and the reservation request constitute a binding offer on the part of the user, but acceptance is subject to operational confirmation by TaxitourSpain (vehicle and driver availability).
  • The user will receive a confirmation of acceptance of the reservation by email.
  • If the reservation cannot be accepted for operational reasons, the user will be notified and a full refund will be issued within 24-48 business hours.

3.2. User requirements

  • Be over 18 years old. Minors must be accompanied by a responsible adult.
  • The transportation of minors will be carried out in accordance with applicable regulations; if a child restraint system is required, it must be specifically requested when making the reservation (see section 5.3).
  • Provide accurate and complete information. TaxitourSpain is not responsible for delays or incidents due to incorrect information.

4. Price, Payment and Billing

The prices shown on the Website for each route or experience are indicated in euros (€) and include the applicable Value Added Tax (VAT).

The final reservation price corresponds to the full service for the vehicle type and the maximum available seating capacity for that vehicle, as selected or assigned during the reservation process, regardless of the final number of passengers using the service, as long as it does not exceed the maximum contracted capacity.

The price includes only those items expressly indicated in the description of the route or experience. Any additional services, such as excess time not contracted (see section 5.2), admission to monuments or attractions (unless expressly indicated otherwise), meals, or any other unspecified items, are not included and must be paid separately by the User.

Payment for the service is made in full in advance during the online booking process. Accepted payment methods are credit/debit cards (through our secure payment gateways Stripe and Paycomet-Banco Sabadell) and any other payment method expressly indicated on the Website.

The User may request a detailed invoice for the contracted service by sending an email to hello@taxitourspain.com, indicating your complete tax information.

5. Specific Conditions of Service

5.1. Nature of the routes and regulatory compliance

Tourist route and experience services in an official taxi, with itinerary, points of interest, and maximum duration specified.

All services are provided in authorized vehicles, with licenses and mandatory civil liability and passenger insurance, in accordance with current legislation for passenger transportation in Spain.

Point-to-point trips and urban/interurban transfers are not considered. For this purpose, the user is referred to www.eltaxi033.com.

5.2. Duration and supplements

The maximum duration is published on each route sheet.

Overtime: If, due to the user's fault, the experience exceeds the contracted time, an additional €10 fee will be charged for every 15 minutes overtime, payable directly to the driver.

The driver will inform the passenger before incurring overtime and requesting payment of the supplement, whenever possible, to ensure maximum transparency.

The availability of overtime will depend on the service schedule and fleet operations.

5.3. Capacity, punctuality, luggage, minors and pets

Each reservation specifies the maximum number of passengers allowed for the vehicle and service contracted. It is the User's responsibility to ensure that the number of passengers, including children of any age, does not exceed the maximum capacity indicated. Children and infants occupy a seat for all purposes and must use approved child restraint systems (CRS) appropriate for their weight and size, in accordance with current regulations. If the User requires a specific CRS (e.g., baby seat, booster seat), they must specifically request it when making the reservation to verify its availability and, if applicable, confirm whether it entails any additional charges.

Pets are not allowed in vehicles, with the sole exception of duly accredited guide or assistance dogs accompanying people with disabilities. In this exceptional case, the User must inform TaxitourSpain of this circumstance at the time of booking to confirm its feasibility and ensure that a suitable vehicle is assigned.

One standard piece of luggage per passenger (one carry-on bag or backpack) is allowed. For bulky or special luggage (e.g., large strollers, sports equipment), the user must consult TaxitourSpain in advance to assess the feasibility, the need for a larger vehicle, and, if applicable, any additional charges.

It is the user's responsibility to be punctual. A 15-minute courtesy period is offered for waiting at the pickup point after the scheduled pickup time. If the passenger fails to show up after this time, the No Show policy may apply (see section 6.1).

6. Cancellation, Modification and No-Show Policy

6.1. Cancellation by the user

  • If cancellation is requested more than 48 hours before the scheduled start time of the service: 90% of the total reservation amount will be refunded. The remaining 10% will be retained for processing fees and bank charges.
  • If cancellation is requested between 48 and 24 hours before the scheduled start time of the service: 20% penalty of the total reservation amount. The remaining 80% will be refunded.
  • Less than 24 hours before the scheduled start of the service or in case of No Show (failure to appear after the courtesy period established in point 5.3): No right to refund (penalty of 100% of the total amount of the reservation).

6.2. Cancellation by TaxitourSpain

Due to force majeure, operational impossibility, severe weather conditions that prevent the safe provision of the service, or failure to meet the minimum number of participants if the route so specifies, TaxitourSpain reserves the right to cancel the service. In such cases, the user will be offered the option of relocation to another date/time (subject to availability) or a full refund of the amount paid, which will be processed within 24-48 business hours.

When an experience requires a minimum number of participants, this condition will be clearly indicated in the route description on the Website.

6.3. Modifications to the Reservation by the User

The User may request modifications to the details of their reservation (such as date, time, number of passengers if the vehicle capacity allows it, or pick-up point within the same city) by contacting TaxitourSpain via email. hello@taxitourspain.com or by calling customer service at +34 618 59 44 08 (Monday to Friday from 9:00 a.m. to 18:00 p.m.).

Deadline to request modifications:

  • Modification requests must be received at least 24h before the scheduled start time of the service.
  • Modification requests received less than 24 hours in advance will not be accepted. in advance of the scheduled start time of the service. In this case, the service will be provided according to the details of the original reservation, or the User may choose to cancel the reservation, subject to the conditions set forth in section 6.1.

Conditions of the modifications:

  • All modifications are subject to TaxitourSpain's operational availability (vehicle and driver availability).
  • If the requested modification involves a change in the price of the service (for example, an increase in the number of passengers requiring a larger vehicle, or a route change involving a longer duration or distance than originally planned), the User will be informed of the new price. The modification will only become effective once the User accepts and, if applicable, pays the price difference.
  • If the change results in a lower price, and provided the 24-hour notice period is met, TaxitourSpain will refund the difference, subject to payment processing policies.

TaxitourSpain will make every effort to accommodate modification requests, but cannot guarantee that all requested changes can be accommodated.

7. Responsibility and Guarantees

TaxitourSpain is committed to providing its service diligently, but is not liable for incidents caused by force majeure, weather, traffic problems, protests, external disturbances, or loss of personal belongings.

The user is responsible for their behavior during the route. The driver may suspend the service without reimbursement if dangerous, disrespectful, or illegal behavior occurs.

The user is responsible for damage caused to the vehicle or to third parties by his or her conduct.

7.1. User and Passenger Responsibilities

In addition to the general obligations set forth in these Terms and Conditions, the User and Passengers expressly agree to:

  • Please adhere to the pick-up time and location agreed upon in the reservation, respecting the courtesy waiting period.
  • Follow the assigned driver's instructions regarding safety and route development.
  • Do not perform actions that may endanger the safety of the driver, other passengers, or the vehicle.
  • Do not consume illegal substances or excessive alcoholic beverages inside the vehicle.
  • No smoking inside the vehicle.
  • Do not cause intentional damage to the vehicle. Any damage caused will be the responsibility of the User who made the reservation.
  • Maintain respectful behavior toward the driver and other potential passengers or third parties during the route.
  • Ensure that minors in your care comply with these rules of behavior and use appropriate child restraint systems if necessary and requested.
  • Do not carry dangerous or illegal objects or objects that could excessively dirty or damage the vehicle.
  • Take charge of your personal belongings. TaxitourSpain is not responsible for lost or forgotten items in the vehicles.

8. Intellectual and Industrial Property

All content on the website (text, images, logos, software, trademarks) is the property of TaxitourSpain or its legitimate owners.

Reproduction, distribution, transformation or public communication is prohibited without express authorization.

Third-party content may be protected by additional rights.

9. Protection of Personal Data

International transfers: Only if services are used outside the EU, applying legal guarantees.

Rights: Access, rectification, deletion, opposition, portability, limitation, and withdrawal of consent.

10. Modification of the Conditions

TaxitourSpain reserves the right to modify these Terms and Conditions at any time.

The new terms will be published on the website and will take effect upon publication.

The user should periodically review the legal texts; contracting after a modification implies acceptance of the new terms.

11. Applicable law and jurisdiction

These conditions shall be governed by current Spanish and European legislation.

For any dispute, the parties expressly submit to the jurisdiction of the Courts and Tribunals of Barcelona, ​​unless otherwise required by mandatory regulations.
